~ and in the Confederate Service ... the Confederates came into the neighborhood and captured me and my brother, Jasper Jackson and a number of others. They threatened us if we did not go with them ... We intended to escape the first chance we got ...
~ Henry Horton of this place was in the same outfit. I believe my captains name was Hunter, but he is dead. ... It may have been the 5th Regiment, Kentucky Cavalry [CSA] ... I believe I was swore into Confederate service at Hager hill near Paintsville, Kentucky ... about January 1862 ... or earlier ... about 6 weeks.
~ I was in the Middle Creek fight under Humphrey Marshall, which was in January or February 1862 ... Marshall was driven back into Virginia by General Garfield ...
~ myself and 6 others ran away after dark, while we were still in Kentucky. This was about a week after the Middle Creek fight ... and three of us, Dan and Jim Bailey and myself came back to Paintsville, Kentucky and laid out into the woods about a week and then west into Paintsville and gave ourself up to the Union Forces. We were not taken prisoners, but gave ourselves up willingly and were paroled. That is, we took the oath not to fight any more against the Union and were then set free.”

DESCRIPTION LIST OF DESERTERS, JULY 31, 1865: “James Littleton, Private Company C, 7th Regiment, Kentucky Infantry, was transferred from Co. E, 22 KY Volunteer Infantry on December 1864 by S.O. No. 96 from District Baton Rouge and Port Hudson, Louisiana. Went home one or two months (the Description List failed to state) before the transfer on sick leave and has never returned nor sent any certificates of Disability. There is a stoppage against him for transportation of $7.90.”
~ War Department Record and Pension Division, Stamped Feb. 28, 1881 or 1891. “James Littleton, Deserted 1 July 1865, Company C, 7th Kentucky Veterans Volunteer Infantry, to which he had been transferred. Application for removal of charge of desertion and for an honorable discharge in this case has been denied.” Littleton never joined the 7th Regiment. FILED INVALID MILITARY PENSION: 18 July 1890.
WAR DEPARTMENT, FEBRUARY 1891: “James Littleton enrolled October 5, 1862 and deserted July 1, 1865 in Company C, 7th Kentucky Veterans Volunteer Infantry to which transferred. Application for removal of charge of desertion and for an honorable discharge in this case has been denied.” [Littleton’s service in the 7th Regiment was untrue. His transfer did not take place. Yet this mistake, continued to be written on his military records.]

HOUSE OF REPRESENTATIVE REPORT, No. 2800, 51st Congress, 1st Session, Kentucky, July 23, 1890: “James Littleton. Littleton was a mere boy when the desertion from Company E, Twenty-second Kentucky Infantry Volunteers, took place, and was persuaded by an older brother to desert. His youth and his voluntarily rejoining his command merits the removal of the charge against him.”
     “The proof of three of his neighbors shows that from the time he arrived home in October 1864, until the fall of 1865, he was sick and unable to return to the Army, owing to his physical condition.”
     “Your committee are satisfied that he was sick and unable to return to his command from the expiration of his furlough until the expiration of his term of service.”
HOUSE OF REPRESENTATIVE REPORT, No. 1180, 58th Congress 2nd Session, Kentucky, February 23, 1904. “James Littleton. This soldier, now 57 years of age, enlisted ... October 5, 1862. Fifteen days thereafter he deserted and was absent in desertion until March 6, 1864, when he gave himself up to the provost-marshal of the Ninth Kentucky district. He appears to have been held in restraint until June 9, 1864, when he was returned to his regiment. On September 5, 1864, he was sent to hospital with bronchitis, and was furloughed from the hospital on September 19, 1864, for sixty days, and was honorable discharged to date November 19, 1864.”
     “The War Department has no record that he was tried by court-martial or that any other action was taken upon the charge of desertion of October 20, 1862.”
     “... the soldier testified that he was under 16 years of age at time of enlistment; that his father had tried to procure his release from the Army by habeas corpus but failed; that he had four brothers besides himself in the company and regiment; that his parents were thus left alone; that he had almost given out on a march on the day before he left in October, 1862 and was advised by his oldest brother to go home; that he did so and remained at home until March, 1864, when he voluntarily gave himself up.”
     “... those who had authority to try him for desertion by court-martial also were satisfied that he did not desert with the intention never to return.”
     “ ... Mr. Keboe ... has stated that the beneficiary’s family was one of the most patriotic ones in the county, four brothers besides the beneficiary having rendered service in the Union Army.
SENATE REPORT, N0. 1480, 58th Congress, 2nd Session, Kentucky, March 14 1904: “James Littleton. Medical and other testimony filed with your committee shows that the soldier is now suffering from chronic intestinal dyspepsia, much flatulence, abdominal pains, alternating diarrhea and constipation, anemia, muscular weakness ... so that he is totally disable by reason thereof for the performance of manual labor.
DECLARATION DOCUMENT FOR THE PURPOSE OF OBTAINING AN INCREASE OF PENSION: Swore 11 May 1912 by James Littleton. Has a current Penison Payment of $27 per month for chronic diarrhea, indigestion piles, disease of rectum, lumbago and loss of left index finger.
